By downloading, installing, or using DualWeather ("the App"), or by using the DualWeather website ("the Website"), you agree to the following terms. If you do not agree, please do not use the App or Website.
DualWeather is developed and operated by an individual developer based in Texas, United States.
DualWeather is a weather application that provides dual-temperature displays, forecasts, and personality-driven notifications across Apple and Android devices. The App is provided for your personal, non-commercial use.
You agree to use the App in accordance with all applicable laws and regulations, and not to misuse, reverse-engineer, decompile, or attempt to extract the source code of the App, except where such restriction is prohibited by applicable law.
DualWeather aims to make best efforts to bring timely and useful weather information to you. However, all weather data displayed within the App is sourced from third-party providers including Apple WeatherKit, Google Weather API, and Visual Crossing. The accuracy, completeness, and timeliness of this data is wholly reliant on the reliability and accuracy of these attributed weather data providers.
Weather information in the App is provided for general informational purposes only. It should not be relied upon as the sole basis for decisions where safety, health, or significant consequences are involved. Always consult official weather services (such as the National Weather Service) and local authorities for critical weather situations, including severe weather events, travel planning, and emergency preparedness.
DualWeather may send you weather notifications and alerts based on your preferences. We do not guarantee the timely, accurate, or complete delivery of any notification. Notification delivery depends on factors outside our control, including your device's settings, operating system behaviour, network conditions, and platform notification services.
Weather notifications from DualWeather are not a substitute for official government weather warnings or emergency alert systems (such as the Wireless Emergency Alert system or NOAA Weather Radio). You should not rely solely on DualWeather notifications for safety-critical weather information.
DualWeather features personality-driven notifications and commentary that present weather information in varied tones and styles. This content is intended to be entertaining and informative, but should not be interpreted as professional meteorological advice. The tone and style of notifications vary by personality and are generated automatically on your device.
We strive to keep DualWeather available and up to date, but we cannot guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control, including but not limited to server outages, network failures, natural disasters, or other events beyond our reasonable control.
We reserve the right to modify, add, or remove features of the App at any time. In particular, if a third-party data source that powers part of the App's functionality becomes unavailable, unreliable, or is no longer tenable for continued use, we may need to adjust or discontinue the features that depend on it. We will make reasonable efforts to communicate significant changes where possible.
If you participate in the DualWeather beta programme (via Apple TestFlight or Google Play closed testing), you acknowledge that beta versions may contain bugs, incomplete features, or stability issues. Beta access may be granted or revoked at the developer's discretion. Beta versions are provided for testing purposes and carry additional risk of data loss or unexpected behaviour.
All content within the App and Website — including but not limited to design, icons, illustrations, animations, text, and code — is the intellectual property of DualWeather and its developer. You may not copy, reproduce, distribute, or create derivative works from any part of the App or Website without prior written permission.
If you provide feedback, suggestions, bug reports, or other communications to us regarding the App or Website, you grant us a non-exclusive, perpetual, royalty-free, worldwide licence to use, modify, and incorporate that feedback for any purpose, including improving the App. Feedback submissions are voluntary and non-confidential.
The App and Website are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, the developer of DualWeather disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Without limiting the foregoing, the developer does not warrant that: (a) the App will meet your requirements; (b) the App will be uninterrupted, timely, secure, or error-free; (c) the weather data or other information provided through the App will be accurate, reliable, or complete; or (d) any defects in the App will be corrected.
To the fullest extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising out of or in connection with your use of (or inability to use) the App or Website, regardless of the cause of action or the theory of liability, even if the developer has been advised of the possibility of such damages.
In particular, because all weather data is provided by third-party services, the developer accepts no responsibility for the accuracy or reliability of the weather information displayed. Decisions made based on information from the App are made at your own discretion and risk.
To the extent permitted by applicable law, the developer's total aggregate liability for all claims arising out of or relating to the App or these terms shall not exceed the amount you paid to the developer for the App in the twelve (12) months preceding the claim, or fifty US dollars (US$50), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, the limitations above shall apply to the fullest extent permitted by applicable law.
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the developer of DualWeather from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the App or Website; (b) your violation of these terms; or (c) your violation of any applicable law or the rights of any third party.
The App relies on third-party services to function, including weather data providers and platform services. Your use of these services is subject to their respective terms and conditions. The developer is not responsible for the availability, accuracy, or conduct of any third-party service.
Your use of the App is also subject to the terms and conditions of the platform from which you downloaded it. Please review the applicable terms:
In the event of any conflict between these Terms and the applicable store's terms, the store's terms shall prevail with respect to your use of that platform. You acknowledge that Apple Inc. and Google LLC are third-party beneficiaries of these Terms and may enforce them against you as a third-party beneficiary thereof.
The app store provider has no obligation to furnish any maintenance or support services with respect to the App. The developer of DualWeather is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify the applicable app store provider, and the app store provider may refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, the app store provider will have no other warranty obligation whatsoever with respect to the App.
We may suspend or terminate your access to the App or Website at any time if you breach these terms or if we discontinue the service. Upon termination, the provisions of these terms that by their nature should survive (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.
You may stop using the App at any time by uninstalling it from your device.
If you have a dispute or concern relating to the App or these terms, we encourage you to first contact us through the contact form so that we can attempt to resolve the matter informally. We will make good-faith efforts to address your concern within 30 days.
If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the state or federal courts located in Texas, United States, as set out under Governing Law below.
These terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles. Any disputes arising from these terms or your use of the App shall be subject to the exclusive jurisdiction of the state or federal courts located in Texas.
If you are a consumer in the European Union or United Kingdom, nothing in these terms affects any mandatory consumer protection rights available to you under the laws of your country of residence.
If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
These terms, together with our Privacy Policy, constitute the entire agreement between you and the developer of DualWeather regarding your use of the App and Website, and supersede any prior agreements or understandings.
We may update these terms from time to time. The "last updated" date at the top of this page will be revised accordingly. Continued use of the App or Website after changes constitutes acceptance of the updated terms.
